Terms & Conditions

Welcome to The Pickleball Place website, owned and operated by THE PICKLEBALL PLACE SDN. BHD. (Registration No. 202401039895 (1585742-T)) (hereinafter referred to as "The Pickleball Place", "we", "our" or "us").

These Terms & Conditions ("Terms") govern, inter alia, the following:

  • Your access to and use of our website and online booking platform ("Website"); and
  • Your booking, access and use of our Pickleball facilities and premises ("Facilities") and/or purchasing products or services or rental of equipment provided by us.

By accessing the Website, making a booking, entering or using the Facilities, purchasing any products or services or renting any equipment, you acknowledge that you have read, understood and agree to be bound by these Terms.

Part A. Website and Booking Terms

1. Eligibility

1.1. By accessing the Website, creating an account or making a booking, you represent and warrant that you are at least eighteen (18) years old and have the legal capacity and authority to enter and be bound by these Terms.

1.2. Individuals below the age of eighteen (18) years of age may use the Website and Facilities only if the booking is made by a parent, legal guardian or another adult who accepts responsibility for the booking and the Terms herein. Such parent or adult who makes the booking is responsible for payment, supervision and compliance with the Terms including the House Rules below.

1.3. If you make a booking on behalf of another individual or a group, you represent and warrant that you are duly authorised to do so and agree to ensure all such persons comply with these Terms.

2. Website Availability

We endeavour to ensure our Website remains accessible at all times, however, we do not guarantee uninterrupted or error-free access to the Website. We reserve the right to suspend, modify or discontinue any part of the Website without prior notice for maintenance, upgrades or operational requirements.

3. Bookings

3.1 Booking Window
Court bookings may be made up to fourteen (14) days in advance through our online booking platform.

3.2 Bookings Confirmation

  • All bookings are subject to availability.
  • A booking is only confirmed once payment has been successfully processed, court availability has been confirmed, and a booking confirmation has been issued by The Pickleball Place.
  • The Pickleball Place reserves the right to decline or cancel any booking where necessary, including but not limited to maintenance, safety concerns, force majeure or operational reasons.

3.3 Multiple Court Bookings
You may reserve multiple courts within a single booking, provided the selected booking times are consecutive and subject to clause 3.2 above.

3.4 Special Events & Tournaments
The Pickleball Place may occasionally organise tournaments, private events, coaching programmes or other activities requiring the use of our Facilities and we reserve the right to reschedule any existing bookings affected by such events. In such circumstances, we will use reasonable endeavours to notify you in advance and offer an alternative booking slot.

4. Purchases or Rental of Merchandise, Equipment and Other Products

4.1 Product Availability

  • In addition to booking of Facilities, we may offer merchandise, rental equipment and other products or services ("Products") for purchase or rental through our Website or at our Facilities, which are subject to availability.
  • Product items placed in your shopping cart are not reserved until payment has been successfully completed. You must present your booking confirmation and details of any Products booked or purchased through the Website on the date of your scheduled booking. We may refuse to provide the Products if proof of such booking or purchase is not produced.
  • Should any purchased or rented Product items become unavailable after payment, we will contact you using the details provided during checkout to arrange an appropriate resolution.
  • All sales of merchandise and Products are final. Once an order has been confirmed, purchased Products cannot be cancelled, exchanged or refunded except where required by applicable laws or expressly approved by us.

4.2 Risk and Title

  • Risk in purchased Products passes to you upon collection at the Facilities.
  • Title to the purchased Products shall pass only upon our receipt of full payment from you.
  • Rental equipment remains our property at all times. You are responsible for exercising reasonable care in the use of the rental equipment and must return it in the same condition as received (fair wear and tear excepted). You shall be liable to any loss, damage or excessive wear resulting from any misuse, negligence or unauthorised alterations.

5. Fees, Orders and Payment

5.1 Fees

  • All fees and rates displayed on our Website are quoted in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless otherwise stated.
  • The Pickleball Place reserves the right to revise the fees or rates from time to time without prior notice, which will be posted on our official Website. Any changes to the fees or rates will not affect bookings or purchases that have already been confirmed and paid for.

5.2 Orders

  • Before completing your booking of Facilities or purchase or rental of any Products or services, you are responsible for reviewing all booking and order details, including selected Product items, court Facilities booking date and time, Product quantities, pricing, and personal information. Please ensure all information is accurate before proceeding with payment.
  • Upon submission, an order summary will be sent to the email address registered to your account. This order summary serves only as an acknowledgement that your booking of Facilities or purchase or rental of any Products or services have been received.
  • Your booking or orders will only be confirmed after payment has been successfully processed, availability has been verified, and a confirmation email has been issued by us. You may also view your confirmed bookings under My Bookings within your account on the Website.
  • The Pickleball Place reserves the right, at its sole discretion, to reject, cancel or refuse any booking or purchase or orders, including but not limited to circumstances involving incorrect pricing, suspected fraudulent activities, system errors, unavailable inventory or circumstances beyond our reasonable control. Where payment has already been processed and paid for a booking or purchase or an order that cannot be fulfilled, we will use reasonable steps to arrange for an appropriate refund or account credit to you.

5.3 Payment

  • Payments for booking of Facilities or purchase or rental of any Products or services may be made using the payment methods available on our website. Accepted payment methods may include credit cards (Visa/Mastercard), supported e-wallets, and other payment methods as made available from time to time.
  • All payments through our Website are processed through our authorised third-party payment service provider, Fiuu. Your payment information is securely transmitted, encrypted and processed by Fiuu in accordance with Fiuu's security standards. The Pickleball Place does not collect, process, store or retain your payment details on our systems.
  • Upon successful payment, a confirmation email will be sent to your registered email address. If there is an issue with your payment, we may contact you using the contact details provided during your booking or purchase.

6. Cancellation, Rescheduling & Refunds of Bookings

6.1 Cancellation Policy

  • Bookings may be cancelled at least twenty-four (24) hours before the scheduled booking time.
  • Any cancellation requests made less than twenty-four (24) hours before the scheduled booking time will be deemed a late cancellation and will not be eligible for rescheduling or account credit. No refunds will be provided in such circumstances.

6.2 Refund Policy

  • The Pickleball Place does not provide cash refunds for confirmed bookings.
  • Where a cancellation qualifies under our cancellation policy, the booking amount will be returned as account credit under My Credits. Account credits are non-transferable, cannot be exchanged for cash, may only be used for future bookings, and remain subject to any validity period specified by The Pickleball Place.

6.3 Rescheduling

  • Bookings cancelled in accordance with the Cancellation Policy above may be rescheduled, subject to court availability, provided the rescheduling requests are submitted within the applicable timeframe stipulated in clause 6.1(a) above.
  • The Pickleball Place reserves the right to approve or decline any rescheduling request based on court availability and operational requirements.

6.4 Weather Interruptions and Rescheduling

  • Where a session has commenced and is, in our reasonable opinion, interrupted, suspended or cannot proceed due to heavy rain or severe weather conditions that render the Facilities unsafe or unsuitable for use, the affected booking may be rescheduled to another available date and time within one (1) month from the original booking date, subject to court availability.
  • Requests for rescheduling must be submitted within forty-eight (48) hours of the original scheduled booking and is subject to our decision as to whether the weather conditions warrant the suspension or non-usage of the Facilities, which shall be final.
  • Any request to reschedule a booking under this clause must be submitted via our WhatsApp hotline at +6011-6189 5140, together with your booking reference and preferred rescheduled date and time, and is subject to availability.
  • Where a booking is rescheduled from a non-peak to a peak hour, the applicable difference in fees shall be payable. No refunds or account credits will be provided for bookings rescheduled from a peak to non-peak hours. A rescheduled booking that is not attended (no-show) shall not be eligible for any further rescheduling, refunds or account credits.
  • We reserve the right to suspend or close the Facilities at any time where weather conditions pose a risk to the safety of users, staff or property.

7. Promotions & Marketing Campaigns

From time to time, The Pickleball Place may offer promotions, promotional codes, discounts, vouchers or other marketing campaigns ("Promotions"). Unless otherwise stated, Promotions are subject to their specific terms and conditions, cannot be combined with other offers or promotion unless expressly permitted, are valid only during the stated promotional period, cannot be exchanged for cash, refunded or transferred, are subject to availability, and may be amended, suspended or withdrawn at any time by us, provided such changes shall not affect Promotions already validly redeemed.

We reserve the right to reject or cancel any Promotion where we reasonably believe it has been used fraudulently, in breach of these Terms, or contrary to the applicable promotional terms or applicable laws.

8. Intellectual Property

All contents on the Website including text, graphics, logos, images and software, remains our property or that of our licensors. No content may be reproduced or used without our prior written consent.

9. Privacy

Any personal data collected through our Website or booking platform will be handled in accordance with our Privacy Policy and applicable Malaysian data protection laws. By using our Website, you hereby agree to us processing your personal data in accordance with Privacy Policy

Part B. Facilities Terms

10. Access and Use of Facilities

10.1 Available Facilities

The Pickleball Place offers a range of facilities and amenities which may include pickleball courts, event spaces, paddle and equipment rental, refreshments, parking facilities, and other amenities as may be made available from time to time. The availability of the Facilities may vary from time to time and is subject to maintenance, operational requirements or scheduled events.

10.2 Facility Usage

  • All Facilities must be used responsibly in accordance with these Terms and any instructions provided by The Pickleball Place or its staff.
  • You shall comply with the Facilities Terms stipulated herein, including the House Rules, respect fellow players and visitors or other users, follow any instructions issued by our staff, use equipment responsibly and appropriately, not damage the Facilities or equipment, and follow all safety instructions issued by our staff or management.
  • Any reckless, abusive, dangerous, unlawful or suspicious behaviour or non-compliance with these Terms or House Rules may result in your immediate removal from the Facilities without any refund to you or recourse to The Pickleball Place.
  • The Pickleball Place reserves the right to suspend or restrict access and usage to any Facilities where necessary for maintenance, repairs or operational reasons.

11. House Rules

To ensure a safe and enjoyable environment at the Facilities, you must comply with the following rules:

  • You must arrive on time for your booked session and vacate the court immediately at the end of your session to allow the next players to commence their session on time. Late arrivals shall not be entitled to an extension of playing time, and booking fees shall not be prorated, refunded or credited for any unused portion of the booked session.
  • Only appropriate non-marking sports footwear to be worn on the courts.
  • Strictly no high heels on the courts of the Facilities.
  • Proper and appropriate sports attire must be worn at all times while playing. Playing shirtless is strictly prohibited.
  • Food and drinks (other than plain drinking water) are not permitted on the playing courts.
  • Smoking, vaping and the consumption of any alcohol or illegal substances are strictly prohibited within the premises of the Facilities.
  • Players must behave respectfully towards fellow players, guests and staff at all times.
  • Anyone with unsafe, abusive or disruptive behaviour may be asked to leave the premises without refund.
  • Please dispose of rubbish responsibly and help maintain the cleanliness of our Facilities.
  • Personal belongings should not be left unattended. The Pickleball Place shall not be responsible for any loss, theft or damage to personal property.
  • Please do not enter or cross an active court while a game is in progress.
  • No pets are allowed at the Facilities.

12. Children

Children aged twelve (12) years and below must be accompanied and supervised by a parent or responsible adult while on the Facility premises at all times. Parents and guardians are fully responsible for the safety and conduct of the children under their care.

13. Assumption of Risk & Waiver of Liability

By entering or using the Facilities operated by The Pickleball Place, you acknowledge and agree that participation in pickleball and other recreational activities involves inherent risks, including but not limited to personal injury, slips and falls, collisions with other players, equipment-related injuries, weather conditions, heat exhaustion, physical exertion, illness, in exceptional circumstances disability or death, and other unforeseen hazards.

You voluntarily assume all risks associated with your participation and, to the fullest extent permitted under applicable laws, release and discharge The Pickleball Place, its directors, employees, contractors, staff and representatives from any claims, liabilities, losses or damages arising from your use of and participation in activities at the Facilities, except to the extent where such loss or damage results directly from our negligence or where liability cannot legally be excluded.

14. Play at Your Own Risk

Participation in pickleball and all other activities at The Pickleball Place is entirely voluntary and undertaken at your own risk. You are responsible for ensuring that you are medically fit to participate and must immediately cease participation if you experience any illness, discomfort or injury.

While we take reasonable steps to maintain a safe environment, it does not guarantee that the Facilities are free from all risks and shall not be liable for any injury, illness, accident, loss or damage except where liability cannot be excluded under applicable Malaysian law.

15. Damage to Property

You shall be fully liable and responsible for any and all loss or damage caused to The Pickleball Place's property, Facilities or equipment through any misuse, negligence or wilful misconduct by you. The Pickleball Place reserves the right to recover the cost of repair or replacement from you.

16. Personal Belongings

You shall be responsible for your own personal belongings at the Facilities at all times. The Pickleball Place shall not be liable or responsible for any loss, theft or damage to personal belongings brought onto the Facilities or premises.

17. CCTV and Photography

  • CCTV is in operation throughout the Facilities for security and safety purposes.
  • You may take photographs for personal use provided that you do not infringe the privacy of others or interfere with the operations of the Facilities or use of Facilities by other players.
  • Any commercial photography by you requires our prior written consent.

18. Parking

Parking facilities are provided for your convenience and are subject to availability. All vehicles and their contents are parked at the owner's or driver's own risk. We shall not be liable or responsible for any loss, theft or damage to any vehicle or its contents, except otherwise stipulated by applicable laws.

19. Reporting Hazards

If you notice any unsafe condition, damaged equipment or accident within our Facilities, please notify a member of our staff immediately. Prompt reporting allows us to take appropriate action to ensure everyone's safety.

Part C. General

20. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, special or punitive loss or damage arising out of or in connection with your access to or use of our Website, the Facilities, equipment, Products or services, or your participation in any activities conducted at the Facilities.

Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable laws.

21. Indemnity

You agree to indemnify, defend and hold harmless The Pickleball Place, its directors, officers, employees, contractors, staff and representatives from and against any claims, liabilities, losses, damages, costs or expenses (including legal fees) arising from or in connection with:

  • Your breach of these Terms & Conditions;
  • Your misuse of our Website, the Facilities, or any equipment, products or services provided by us;
  • Your negligent, reckless or unlawful acts or omissions;
  • Any damage to our property or the property of any third party caused by you or any person attending the Facilities under your booking; or
  • Any injury, loss or damage suffered by any person arising from your acts or omissions.

22. Force Majeure

The Pickleball Place shall not be liable for any delay, cancellation or failure to perform our obligations from events or circumstances beyond our reasonable control, including but not limited to adverse weather, flooding, fire, acts of God, power failures, government restrictions or orders, pandemics, strikes, equipment failure or any other unforeseen event beyond our reasonable control.

23. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

24. Severability

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

25. Entire Agreement

These Terms constitute the entire agreement between you and The Pickleball Place relating to your use of our Website, Facilities, equipment, Products or services, and supersede all prior communications, representations or agreements relating to the same subject matter.

26. Waiver

Failure by The Pickleball Place to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision or any other provision at a later time.

28. Definitions

"User", "you" or "your" means any individual who accesses or uses the Website, makes a booking or purchase, rents equipment, enters or uses the Facilities, participates in any activities at the Facilities or otherwise accesses or uses any products or services provided by us, including any customer, participant, guest, visitor or other person attending the Facilities pursuant to a booking.

29. Amendments

The Pickleball Place reserves the right to amend or update these Terms & Conditions from time to time. The latest version will apply and supersede all previous versions, including any printed materials. Please check our website at www.thepickleballplace.my regularly for the most current version, indicated by the update date at the bottom of this Terms & Conditions.
